Litigation (in all courts)

K-INC is very experienced and provides commercial litigation services. Esmeralda has 10 years of litigation experience and has been exposed to several high-profile cases including urgent applications in the past, appearing alongside much- respected advocates in seeking justice on behalf of clients. There is an abundance of well-documented jurisprudence to support this. Our clients include financial institutions, mining companies, and other private businesses.

Conveyancing

K-INC conveyancing services which includes, but is not limited to bond registrations, transfers, developments, registrations of notarial deeds, bond take overs amongst other related matters.

Corporate

K-INC is well experienced in advising on corporate law (company law) and commercial matters to especially the corporate clients who enlisted its services as above. To this end, legal opinions are provided in various areas of law.

Labour matters, inclusive of assistance with drafting on human resources policies and procedures

Mrs. Katjaerua has been chairing and continues to chair many disciplinary inquiries at FNB and other private companies and provides legal advice in this field. She has assisted NASRIA and other corporate giants with updating of its human resources policies. She is well versed with all provisions of the Labour Act 11 of 2007, as amended, and with the appearance and resolution of Labour disputes (Office of the Labour Commissioner).

Debt Collections

We appreciate the tough economic times we are in and as such we take time to listen to and understand the people from whom we collect money. In collecting debt, we approach the mandate with a sense of humanity and dignity considering these aforementioned factors. We also fully engage our clients to appreciate their expectations. The firm currently provides this service to First National Bank, SME Bank, and Development Bank of Namibia and other private institutions.

Family Law

K-INC offers specialized and superior service in all matters relating to family law. In that regard, K-INC attends to maintenance inquiries, and domestic violence inquiry and have a wide range of divorce clients. K-INC prides itself in dealing with these matters with the greatest sensitivity it deserves. There is an abundance of well-documented case law on litigated divorce matters done by Mrs. Katjaerua.

Alternative Dispute Resolution

Not only is K-INC well versed with court-annexed ADR processes in the High Court of Namibia, but she also has exposure to, and is well experienced in offering private arbitration services as well as assisting clients with drafting valid arbitration agreements. K-INC believes that most, if not all, disputes can be resolved privately without the need to engage in the often-protracted court processes.

Intellectual property

Mrs. Katjaerua has successfully advised clients on matters related to intellectual property and has successfully registered a trademark for its corporate client: “I am Namdia, I am Namibian.”

Competition Law and Policy

K-INC serves the Namibian Competition Commission and conducts investigations in terms of the Competition Act. Since its inception, K-INC has acted for a big corporate on two mergers and filed a merger notice to the Competition Commission on behalf of this corporation

Criminal Law

Mrs. Katjaerua has successfully acted on behalf of private clients in bail applications and other criminal matters. The two candidate legal practitioners have been extensively trained in this regard and will add much-needed capacity in this space.

Estate Administrators

Mrs. Katjaerua has successfully been added to the list of Estate Practitioners and will offer this service at K-INC. Our candidate legal practitioner, Ms Georgia Benade, was employed at the Master of the High Court and specifically deals the administration of deceased estates and liquidation of companies alike. K-INC thus has excellent skills set in dealing with liquidations and estates.

Notary Service

Mrs Katjaerua is a Notary Public since 1 August 2018 and offers this service to the clients of the firm. This is particularly applicable to anti-nuptial contracts and 14 for company registrations, among other matters.
